Introduction

Santa Farma İlaç San. A.Ş. (to be referred to as ("Santa Farma", "Company" or "We") attaches utmost importance to processing personal data in accordance with the law. This Data Protection Information Text for Candidate Employees (“Information Text”), has been prepared in accordance with Article 10 of the Law No. 6698 on the Protection of Personal Data (“Law”) and relevant legislation, for the purpose of processing the personal data of you, our candidate employees, in a transparent manner.

As the Company, we would like to inform you in detail about your personal data that we process. In this context, the Information Text provides details regarding which of your personal data we process for what purposes, the duration for which your data is stored, third parties to whom the data is shared, your rights, and the methods by which you can contact us.
To obtain more detailed information regarding the processing of your personal data, you may examine the Data Controllers Registry (VERBİS (https://verbis.kvkk.gov.tr/) maintained by the Personal Data Protection Authority.

Which Personal Data Do We Process and How Do We Obtain Your Personal Data?

General information regarding your personal data processed by Santa Farma is as follows:

  • Identity and Contact Information:: Name, surname, place of birth, date of birth, marital status, driver's license details, T.C. Identification No., passport details, address, e-mail, telephone, mobile phone, contact details.
  • Application-Related Information: Information contained in the CV, letter of intent, profession and professional experience information, social media information, education details, skills and competencies, reference contact details, requested salary information, hobbies, course and certificate details.
  • Visual Records: Photograph.
  • Special Categories of Personal Data: Health data processed for the determination and evaluation of health criteria required for Santa Farma's working conditions, disability status, association, foundation, or trade union membership details depending on your preference, data regarding criminal convictions and security measures.
  • Transaction Security:: IP address information obtained through cookies, log records, user account details.
  • Other Information: All kinds of personal data processed to form the basis for the personnel rights of our employees or natural persons in a business relationship with our Company, as well as necessary information to evaluate suitability for overseas assignments (visa information, residence permit, work permit, citizenship/dual citizenship information). Your personal data is obtained directly through you, as well as from recruitment specialists and persons you have specified as references to Santa Farma.

Your personal data may be obtained through fully or partially automated or non-automated means from the beginning of your job application process, in order to fulfill various legal obligations and ensure the continuation of the process, via printed physical documents (for example, CV information or social security statements submitted by you), forms (for example, Employment Entry/Periodic Medical Examination Application Form) and, in some cases, employment agencies from which you receive services.

Your personal data is obtained in accordance with national and international legislative provisions, primarily the fundamental principles in Article 4 of the Law, and is processed in accordance with Articles 5 and 6 of the Law. Regarding your special categories of personal data, the processing conditions listed in KVKK Art. 6/3 are applied, and adequate measures determined by the Board pursuant to Art. 6/4 are taken.

We remind you that if you transfer the personal data of reference persons you have provided in your job application to us, the obligation to inform and obtain explicit consent from the relevant persons belongs to you.

For What Purposes and Based on Which Legal Grounds Do We Process Your Personal Data?

Your personal data is processed in accordance with the Law for the following purposes. Data obtained during candidate employee processes may continue to be processed in the event an employment contract is signed, provided that there is no change in purpose.

  • Data processing is mandatory for the legitimate interests of the data controller,

  • It is mandatory for the fulfillment of legal obligations in the fields of employment, occupational health and safety, social security, social services, and social assistance.
  • Your explicit consent regarding your association, foundation, or trade union membership details.
  • It is mandatory for the establishment, exercise, or protection of a right regarding your details on criminal record, criminal conviction, and security measures.

To Whom and For What Purposes Do We Transfer Your Personal Data?

We may transfer your personal data processed by us to third parties domestically or abroad in line with the purposes specified above, within the framework of national and international legislation provisions, primarily Articles 8 and 9 of the Law.

The transfer of your personal data abroad is carried out within the framework of KVKK Art. 9 and the Regulation on the Procedures and Principles Regarding the Transfer of Personal Data Abroad.

The third parties to whom we may transfer your data are categorically as follows:

  • Our Domestic and International Suppliers: Your personal data is shared with third parties such as suppliers from whom we receive services, financial advisors, financial audit firms, non-Company occupational health and safety specialists / workplace physicians, or other consultancy service providers. Additionally, within the scope of our activities, in some cases, details such as identity information or CV information of our candidate employees may be shared with third parties such as career companies.
  • Administrative and Judicial Authorities Authorized Pursuant to Applicable Legislation: Your personal data is shared with authorized private and/or public institutions and organizations, administrative and judicial authorities authorized by national and international legislation, if required by law or if necessary for the protection of our legitimate interests in order to ensure compliance with applicable legislation. For example, data may be shared with state authorities and/or law enforcement agencies, relevant institutions in case of audits within the scope of Employment and Employment Agency Law, Labor and Social Security Legislation, and tax audits.

What Rights Do You Have as a Data subject?

You may submit your requests regarding your personal data processed by Santa Farma within the scope of Article 11 of the KVKK at any time to the addresses below, in writing in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, or by using a registered electronic mail address (KEP), electronic signature, mobile signature, or your electronic mail address previously notified to us and registered in our systems.

Requests submitted within this scope will be concluded by Santa Farma free of charge as soon as possible and within thirty days at the latest. However, in the event that a fee is stipulated by the Personal Data Protection Board, the fee specified in the tariff determined by our Company shall be charged.
